All sample assets provided by Unity Technologies are free to use in commercial applications / games unless stated otherwise.
The only thing that may hinder you to use the Unity Default character is that potential player may have seen the character in other games before. If that's no problem for you go ahead and use it.

Assets provided by Unity can be used by you without and copyright problems. However bear in mind that assets provided by Unity will be known by many users, so your use of them will be noticed, and may leave you criticised by people playing your game.
