Do I need brand permission to use their car design in my racing game?
Hello
I am making a racing game with Unity. I am going to get most of my car models from turbo squid and they are all based off of real cars (Audi, Porsche etc.) I want to know before I buy the models, do I have to have permission from the car manufacturers (Porche, Lambhorghini etc.) to use their car design in my game. I'm already taking out all brand logos from the game and their names out from the menu and putting in fake names. So basically its the exact same as the real car except its called something different and doesnt have the brand logo anywhere. I did that in the hope that my game would be immune to legal problems but first before I buy the models I would like to know how much I have to take out or put in to make it immune to legal problems. I already made contact with Lamborghini to ask them how much I would have to do but they didnt disclose any significant information regarding copyright.
Thank you in advance
P.S. Im sorry but Im not a lawyer so if you could put any complex legal advice into simple language for me to understand that would be great.
As long as the car is only based on the same design and you don't use the brand names, I think you'll be safe.
O$$anonymous$$ so if I maybe made the boot smaller and changed the door size would it be O$$anonymous$$ or would I have to change more
I'm in no way a lawyer, so it probably wouldn't be the best idea to go just by my advice, but I believe it completely depends on the company/car, the patents, etc...
This really isn't the place to be asking for legal advice, and it's not a Unity-specific question.
You are asking for legal advice on a 'site that is for Unity specific technical questions, no-one here can answer it. What happens if you do get sued, say 'but Unity Answers said it was ok' ? That's not going to hold up in court. Quite simply, you need to ask an expert in the field of law. Look at some case examples. Forza for example have partnerships and deals. Now look at GTA, all pseudo cars. I have also read in the past that games that were licenced to use real cars couldn't show them in a damaged state. So really, if you want an actual answer that will not get you sued (and be able to sleep at night), you need legal advice from an expert, it's for your own good and peace of $$anonymous$$d.
