Question by GameStar18 · Jan 31, 2014 at 03:01 AM · tutorialsystemcopyright

Use copyright models for creating a sellable system?

After gaining a lot of experience in Unity I am ready to create my own beat em' up system that I plan on selling to allows others to create their own beat em' ups. I only have access to Mario characters and they would be perfect to use in this for tutorial/example project purposes. I was wondering if having copyrighted characters in this system would not allow me to be able to sell the system for a small price when I am finished? I don't plan on selling this as a game by any means, just for the beat em' system I create.

Thanks!

This is really not the place to ask for legal advice.

No, you can't use copyrighted material, even when you publish your game / system / tutorial for free. Either make your own or search for free models you can use. Watch out: there are a lot of free models out there which are only free for non commercial use. So make sure the free model you're downloading are published with a suitable license.

Also, many (most?) of the "free" models you will find just searching randomly are going to be rips in the first place- you also need to consider if the website is a legitimate source and if their submissions are checked or anyone can just post "their" free model no-questions-asked.
