Assets under the "Assets" folder are compiled into an asset library of sorts, so they already exist, but you no longer see the folder structure. I'm not sure if .json files would be part of that since they're not a normal Unity asset, or they're treated like text assets.
If you want to be able to load them at runtime you can put them in folder called Resources, then use Resources.Load to load them at runtime.
If you want an actual folder then I'm pretty sure it needs to not be under the Assets folder. In that case you can create a post build process to copy the folder over after a build.
