Licensing for Contractors v4.1.5

Hi,

We are a iOS dev studio and are working on an app for a film production house.

We used Unity 4.1.5 Free version. As I understand from the license, we can publish the game on iOS and Android without the need for buying Pro license as our revenues have not hit more than $100,000/year in past fiscal year.

Now the complication is the production house wants to launch the app from their Apple and Google account and they wanted to know since they are not the ones developing the software and they have contracted it to us, they should not have to pay for Pro license just for hosting on the App store and Google Play.

Can this be achieved? i.e. hosting on their accounts without paying for Pro license?

Also, if not whats the workaround? They said it was imperative that the app be hosted on their account. Can someone please help with this?

Some input from Unity Team would be great as well so we are assured we have an official answer as this is in relation to licensing issue.

FWIW: I ask my clients to buy their own Unity Pro license to avoid problems like this, as well as have an in-house license in case they want to work on it or let someone else work on it. And if they make more than 100k then they're covered and so am I.

Yeah ... Thanks Dave ... That would have been ideal to start with :) ... We are definitely taking with that route going forward ... Just trying to get out of this soup right now and make sure a great app just waiting to hit the store makes it :)

I'm afraid it's probably the case that they have to buy a license (or you do on their behalf). I'm presu$$anonymous$$g that you aren't deriving your income from the fee paid to play the app? (Which would make your income relevant); in fact they have appointed you to produce something to make them money (by marketing their film) and so it requires a Pro license.

If you think of this analogy - you couldn't argue that you don't need a Pro license because although your company makes $1m turnover per year, the programmer who uses it is only paid $60k.

Exactly. You may make a few thousand, they may make a few million. They can certainly afford the license. You could even have them buy YOU the license as part of your compensation, if you don't have one.

If the film production studio want to make the final build, then yes, they will need a Unity license. And if they make over $100k, then they will of course need to purchase Pro versions of Unity.

Well, now I come to think of it... you could ship them the XCode project and leave them to edit the project to suit their requirements.

We will be building the final product and just sharing the xcode project with them. In-fact we can just provide them the ipa and apk (in case of Android) built with their distribution profile. $$anonymous$$y main concern is if they publish the app using their Apple account (for which they have registered using their company's name), would they need the Pro license (not to build but jus to publish)? Does that count that they are publishing the app so they will be evaluated under the licensing terms (whether free applies to them or not).

But saying that - why don't you email support or sales or call them? I'd suggest that is a better route than asking the question on a community forum if you want something you could use in court should Unity take action against you for breach of contract.
