Can I use assets in game which i publish? Definite answer needed! (answered)

To keep in short but hopefully concise, like the question in the FAQ -

Can we use the code/art/assets in Unity Technologies' example projects?

Yes, all assets in our tutorial and example projects may be used in both commercial and non-commercial use in Unity-based projects. The assets themselves may not be resold, however.

Can we use assets from the asset store in the same way, for 'commercial and non-commercial use' but still respecting 'The assets themselves may not be resold, however'?

I have searched through many webpages and question on here but struggle to find a single concise answer like the one in the FAQ (but on the right question). Furthermore i have looked as the ASSET STORE TERMS OF SERVICE AND EULA http://unity3d.com/legal/as_terms which has two articles which can conflict or agree and be used both ways (1.3 and 3.8) -

"You may use Unity Asset Store to browse, locate, and download Assets (defined as (i) software or software development kits designed in order to facilitate the development of electronic games and interactive media (ii) content (for example – without limitation – computer graphics, including 3D computer graphics, sounds and music), tutorials and other digital materials created in order to become integrated parts of electronic games)."

"You agree that you will not, and will not allow any third party to, (i) copy, sell, license, distribute, transfer, modify, adapt, translate, prepare derivative works from, decompile, reverse engineer, disassemble or otherwise attempt to derive source code from the Unity Asset Store or the Assets, unless otherwise permitted,"

So here i am asking you the wide unity community looking for a universal definitive answer as i do not want my games in the future to have a fatal weakness. Thank you, i hope you can share your opinion but if not please vote up the answer which you think is most correct.

That quotation states : You can download stuff from the asset store. The second one is standard EULA to protect peoples' works.

Unless otherwise permitted, is key.

See 2.2, under End Users Rights and Obligations:

"Licensor grants to the END-USER a non-exclusive, worldwide, and perpetual license to the Asset to integrate Assets only as incorporated and embedded components of electronic games and interactive media and distribute such electronic game and interactive media"

Ie. you can put it in your game. It then goes on to say, very clearly, that you may only put it in your game, and not do much of anything else with it.

As far as I can tell, the only murky point is 2.4, which covers editor extensions. If an asset is an editor extension, you need one licence per computer (this is clearly marked in the store, see an example here, where it says "This extension requires one license per seat" under the price). There's no information about wheter you can use assets included in an editor extension in your game.

As an example - say somebody's included some example meshes and textures with their editor extension. Can you use them in your game? I don't think so, unless maybe if every $$anonymous$$m member owns the extension. You can definitely use assets generated by that extension, though, so I'm not clear here.

But if you buy an AI solution or a texture pack or whatever, of course you can use it in your game. There wouldn't be any point in those existing otherwise. You can also use it in any game you make, forever.

Each asset from the Asset Store comes with its own license. Most of these will follow the basic EULA as specified on the Asset store pages but there are those that follow different licenses (Also specified by Unity). There are no circumstances in which submissions follow Custom or user-defined licenses as this is not allowed under the terms of Asset Store Submission rules.

So bottom line is, read the License/EULA of the asset itself. It'll tell you in there. If you see no License information, the Basic EULA applies. You already have this. It may help to read the submission guidelines also, to see things from the other point of view.

You must consider though, If you couldn't, what would be the point of the asset store?

You just arent allowed to resubmit other peoples work to the Store.

Where do you find the License/EULA of each asset? I am on the asset store. Also, I understand you are not allowed to resubmit other people works 'The assets themselves may not be resold, however.' but i wonder can you use them in games 'may be used in both commercial and non-commercial use in Unity-based projects'. I wonder what the point of the asset store would be if you could not use assets in your games. So are you saying mostly you can or can't - but you must check the specifics?

Well the point of the store is to use the Assets "For their intended purpose" which is in your games as per the standard EULA. If you can not for any reason it will be sold under a separate license and that should be specified on the Asset page.

If it turns out you have bought an Asset which has a special license but this was not specified, you should contact the Asset Store $$anonymous$$m.

Thank you, so you are saying that you can use them in your game as what would be the point of assets if you could not but in some rarer cases a separate license may be specified which may affect the license. So mostly yes.
