Will I have copyright problems if I were to release this game?
Hi guys! So recently I am planning to take up a project which is a horror game , but the catch is that the villain is a heavily photoshopped version of the purple dinosaur Barney which looks really scary. But will I get sued for using Barney in my game if I were to release it?
Why don't you ask Barney? I mean the creators of Barney?
Interestingly Barney seem to have been getting some lawsuits too.
"The Electronic Frontier Foundation hosted online archives from the Computer Underground Digest that contained Barney parody material. In 2001, Gibney, Anthony & Flaherty, LLP, lawyers for Lyons Partnership, issued a threat letter to EFF clai$$anonymous$$g infringement of the Barney character. EFF strongly defended itself against these claims citing the established defence of parody, backed by United States First Amendment protections."
Note that nothing I say here is legal advice. I just found it a little intriguing to read about Barney online.
